Drug Trafficking
Miami, FL Drug Trafficking Criminal Defense Lawyer
Bruce H. Lehr
In the state of Florida, if you are caught in possession with a large enough quantity of a controlled substance you can be charged with the crime of drug trafficking. Depending on the circumstances of your arrest and the weights involved, you can be charged under Florida State Statute 893.135 or the federal drug trafficking laws. In either case minimum mandatory sentencing applies. South Florida criminal defense attorney Bruce Lehr has defended many individuals against state and federal drug trafficking charges. As a one-time Dade County prosecutor, attorney Bruce Lehr is very familiar with the South Florida criminal justice systems and has a reputation as an aggressive and knowledgeable criminal defense attorney.
How Narcotics Trafficking Works in Florida
Regardless of whether you allegedly bought, sold, manufactured, imported, or cultivated drugs, it's the weight of the narcotics in question that will determine whether you are charged with trafficking or a lesser crime. Under Florida law, if you exceed these weights, you may be charged with drug trafficking:
- Trafficking in Cannabis/Marijuana: 25 lbs
- Trafficking in Cocaine: 28 grams
- Trafficking in Heroin, morphine, opium, oxycodone, hydrocodone, hydromorphone: 4 grams
- Trafficking in amphetamine or methamphetamine: 14 grams
- Trafficking in GHB: 1 kilogram
This is a general guideline for only some of the more common controlled substances. These weights are the minimums required to reach a trafficking charge. Federal trafficking charges require greater weights, but the penalties are also substantially more severe. Additionally, Florida has enhanced penalties for greater weights. If you have been charged with drug trafficking or any other narcotics-related crime, immediately seek the legal services of a Florida criminal defense attorney whose focus is on narcotics crimes—a criminal defense lawyer like Bruce Lehr.
